Can I break my lease if there's mold in my apartment? ?
I live in Cecil County, Maryland, and recently when the hurricane rain came through our area I discovered a rather large leak coming from my chimney in the attic. However, when I went downstairs to see if there was any damage, it was pouring water in my closet on the other side of the room. I had noticed about three weeks prior there was a huge black spot forming on my ceiling. I immediately called my landlord, and he told me that, "mold can't grow that fast." The spot was not there when I moved into my apartment, and my guess is that it's been slowly growing every time it rains. My landlord then sent a henchman out to look at my ceiling, and he told me it was soot, and promptly cleaned it up with greased lightning. Why would there be soot in my closet? That's just crazy. So, I then called my landlord to tell him I wished to be notified before anyone came in my house to repair anything else, because I wanted someone to be home. He did not bother to notify me, and sent someone in my house to "repair" the damage to my closet. He called and left a message on my phone stating, "I'm curious as to what the problem still is. I sent someone over to re-screen your chimney, and I sent someone over with a solution to clean up any mold in your apartment." I thought it was soot...now it's mold? So that means it's all in the wall, and he didn't even change the sheetrock...he just stirred up my mold. I know he's not going to bother replacing all the necessary things to make my apartment safe. I'm going to contact a mold company to identify the extent of the problem, and I have multiple pictures that were taken before the mold was "cleaned up." I also have the message where my landlord mentions that it was mold cleaner...and nothing about soot. I've been advised that I should contact my housing authority and then my states attorney. I always pay my rent on time, and I really don't think I deserve to be treated so poorly. I just want to break my lease and move out. Is there any way I can do this? Or do I have to fight with my landlord to clean up my moldy apartment and stay for the remainder of my lease? Is there anyone I should contact? Please help me! Thank you in advance. The mold isn't just in the closet where it's visible. It is in the entire wall from the chimney over to the closet. When the mold in the closet it sprayed it simply keeps coming back because there's an underlying problem. So, I can't simply take care of it myself.
